Luis Fernando Esquivel-Garcia was released from criminal custody on April 20 after Hingham District Court refused to honor an ICE detainer — federal agents picked him up nearly a month later.

HINGHAM — A Guatemalan illegal immigrant facing seven Massachusetts charges — including two counts of indecent assault and battery on a child under 14 — was released into the community in April after Hingham District Court refused to honor a federal immigration detainer, ICE Boston announced this week.
Luis Fernando Esquivel-Garcia was set free from criminal custody on April 20, according to U.S. Immigration and Customs Enforcement's Boston field office. Federal officers caught up with him on May 15 — nearly a month later — and took him into ICE custody pending removal.

Esquivel-Garcia's open Massachusetts criminal case includes two counts of indecent assault and battery on a child under 14, and five counts of procuring alcohol for a minor.

The indecent-assault-on-child charge carries up to 10 years in state prison under Massachusetts law.
Hingham District Court released him from criminal custody on April 20, 2026 — refusing the immigration detainer that would have transferred him directly into ICE custody at the end of his Massachusetts case.

ICE picked him up anyway

ICE Boston announced the May 15 arrest on X this week, naming the court that released him.
"The Hingham District Court did not honor our detainer and released him from criminal custody on April 20, 2026," ICE Boston's Enforcement and Removal Operations field office wrote. "ERO Boston will ensure these dangerous criminals do not remain in our communities."
Esquivel-Garcia is now in ICE custody pending removal proceedings.
