BROCKTON — A Brockton man accused of driving drunk, blowing through a red light, and killing two people in a crash so violent it engulfed a car in flames has been released on just $5,000 bail.
The Plymouth County DA asked for $100,000. The judge gave him a twentieth of that.
Mario Hernandez, 32, was charged Tuesday with two counts of motor vehicle homicide, operating under the influence of alcohol, reckless operation, and a red light violation, according to Plymouth County District Attorney Timothy Cruz’s office.
If he posts bail, Hernandez must not drive, remain alcohol-free, and undergo screenings four times a day. That’s the punishment, for now, for allegedly killing two people.
The crash
On November 14, around 1:30 a.m., Brockton police responded to the intersection of Centre and Quincy streets for a two-vehicle crash. They found a 2019 Infiniti Q50 engulfed in flames with occupants trapped inside and a white box truck flipped on its side.

Two people dead
Justin Pratt, 24, a passenger in the Infiniti, held on for just over a week before dying from his injuries. Shane Spillane, 26, another passenger, was pronounced dead at Boston Medical Center South in Brockton.

Prosecutors asked for $100,000 bail and requested that bail in a separate, unrelated case be revoked. The judge set bail at $5,000.
Hernandez already had an open case when this crash happened. Two people are dead, a car was on fire, and the man accused of causing it walked out for less than the cost of a used car.
He’s scheduled to return to court on June 2.
